1. About these terms
By registering for, joining or attending any event run by Nathalie Panic-Vaucher (ABN 36 032 357 521) ("we", "us", "our"), you ("you", "participant") agree to these Terms of Service.
"Event" means any masterclass, webinar, workshop, challenge, group session or other live or recorded program we run, whether online (for example via Zoom) or in person, free or paid.
These terms work alongside our Privacy Policy, which explains how we handle your personal information. If you sign a separate agreement with us for a particular program, that agreement applies where it differs from these terms.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
2. What coaching is (and isn't)
Our events offer coaching, education and personal development, including life coaching, results coaching and related approaches. Coaching is a partnership to help you clarify goals and take action; you remain responsible for your own choices.
Coaching is not therapy, counselling, psychology, psychiatry, medical treatment, or financial, legal or business advice. Nothing shared at an event is a diagnosis or a substitute for advice from a qualified professional who knows your circumstances.
If you are receiving treatment for a physical or mental health condition, please continue to follow your health professional's advice. If you are in crisis or feel unsafe, contact emergency services on 000 or Lifeline on 13 11 14 rather than relying on an event.
Some events include reflective, visualisation, breathing or movement exercises. Take part only as far as feels right for you, and step out at any time.
3. Registration and payment
You must be 18 or older to register for and attend our events.
Please give accurate details when you register. Your registration is personal to you; links, logins and access may not be shared or passed on without our written consent.
Free events: registering does not guarantee a place, and we may limit numbers.
Paid events: prices are in Australian dollars (AUD) and include GST where applicable. Your place is confirmed once payment is received. Payments are processed securely by our payment provider, as described in our Privacy Policy.
If you choose a payment plan, you agree to pay each instalment on time. If a payment fails, we may pause your access until it is up to date, after letting you know.
During some events we may offer further programs or services. Buying them is entirely your choice and is covered by the terms provided at the time of purchase.
4. Cancellations, refunds and credits
Cooling-off period. For courses and paid programs, you may cancel for a full refund by emailing [email protected] within 3 business days of enrolling.
Change of mind after cooling-off. After the cooling-off period, we do not give cash refunds for change of mind. Instead, the amount you paid is held as a credit you can use towards another of our events or programs.
If we cancel or reschedule. If we cancel an event, you may choose a full refund or a credit. If we change the date or time significantly and the new time doesn't suit you, you may choose a full refund or a credit.
Your rights under the law. Our services come with guarantees under the Australian Consumer Law that cannot be excluded. If a service has a major failure, you are entitled to cancel and receive a refund for the unused portion, or compensation for its reduced value. Nothing in this section limits those rights.
Missed sessions. If you can't attend a live session, a recording may be made available where we offer one; this is not guaranteed for every event.
Products. Faulty products are covered by our 30-day replacement policy and by your rights under the Australian Consumer Law.
5. Taking part in online events
Respect and confidentiality. Our events are a safe space for sharing. Please treat other participants with courtesy, and keep what others share during the event confidential. Do not record, screenshot or share other participants' names, images or stories.
Conduct. We may mute, remove or refuse entry to anyone who is abusive, discriminatory, disruptive, or who promotes their own products or services to other participants without our permission. If removed for conduct, you are not entitled to a refund except where the law requires one.
Recording. We may record online events (video, audio and chat) to share replays with participants and to improve our programs. You'll be told at the start of any session that is recorded. If you prefer not to appear, you can turn off your camera, mute your microphone, change your display name, or send private questions by email. Recordings are handled in line with our Privacy Policy.
Testimonials. We will only use your name, image, words or results in our marketing with your express permission, and you may withdraw that permission at any time for future use.
Technology. You are responsible for your own device, internet connection and access to the platform (such as Zoom), which has its own terms. If a technical problem on our side stops an event from going ahead, we will reschedule or provide a recording, refund or credit.
6. Our content
All materials we provide (including slides, workbooks, recordings, frameworks, exercises and audio) are owned by or licensed to us and protected by copyright.
You may use them for your own personal development. You may not copy, record, resell, share, teach or publish them, or use them to train others or build your own programs, without our written permission.
7. Results and responsibility
No guaranteed results. Stories and results shared at our events are examples of what is possible, not typical or promised outcomes. Your results depend on your own circumstances, effort and decisions.
Your choices. You are responsible for the decisions and actions you take during or after an event, including any changes to your health, relationships, work or finances.
Our liability. We provide our events with due care and skill. To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your attendance at an event or your use of its content. This does not limit our responsibility for loss caused by our negligence, or your rights under the Australian Consumer Law.
8. Privacy and communications
We collect and use your personal information as set out in our Privacy Policy, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
When you register, we will send you emails or SMS about the event (such as joining links, reminders and replays). We may also send you information about our other programs. You can unsubscribe from marketing at any time using the link in each message, and opt out of advertising by emailing [email protected] with "opt out of advertising".
9. General
Changes. We may update these terms from time to time. The version published when you register for an event applies to that event.
Governing law. These terms are governed by the laws of Queensland, Australia. You and we submit to the courts of that state and the Commonwealth.
Severability. If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.
Complaints. If something isn't right, please contact us first and we will work with you to resolve it promptly.
